Who can use the Services

You must be at least 16 years old to create an account, and at least 18 years old to place an order. By using the Services you confirm that you meet this requirement. If you are a consumer in the EEA, the UK, or another jurisdiction with mandatory consumer rights, those rights apply alongside these Terms and are not limited by anything stated here.

Your account

You are responsible for keeping your account credentials secure and for all activity that takes place under your account. Notify us at info@gukkimukk.com if you suspect unauthorised access.

You may close your account at any time from your account settings. We may suspend or terminate accounts that breach these Terms or that are used for fraudulent or abusive activity.

Products and orders

Most GUKKIMUKK™ products are made-to-order through our production partners and are produced individually after you complete checkout. Product images, colours, sizes, and material descriptions are provided for guidance; minor variations in print placement, colour appearance, material texture, sizing tolerance, and finish are inherent to print-on-demand manufacturing.

An order is accepted only once you receive an order confirmation email from us. We reserve the right to refuse or cancel any order — including for stock or pricing errors, suspected fraud, or shipping-address restrictions — and to refund any payment in such cases.

Pricing, taxes, and payment

Prices are displayed in the currency selected on the site and may be inclusive or exclusive of taxes depending on your location. Applicable VAT, sales tax, and shipping charges are shown at checkout before you confirm your order.

Payments are processed by Stripe via Stripe's hosted checkout. Card details are submitted directly to Stripe and never reach our servers. By placing an order you authorise us (via Stripe) to charge the total amount displayed at checkout.

Shipping

Shipping methods, estimated delivery times, available regions, and carrier responsibilities are described in our Shipping Policy, which forms part of these Terms.

Returns and refunds

Returns, cancellations, defective or wrong items, delivery delays, and other refund matters are governed by our Refund Policy, which forms part of these Terms.

EU consumer right of withdrawal

If you are a consumer resident in the European Union, EU Directive 2011/83 (the Consumer Rights Directive) grants you a 14-day right to withdraw from distance contracts. Article 16(c) of that Directive provides an exception for goods that are made to your specifications or clearly personalised. Because GUKKIMUKK™ products are produced individually on demand after you place your order, this exception applies and the 14-day right of withdrawal does not apply to such products.

For any non-made-to-order items (where applicable), the 14-day right of withdrawal applies in accordance with the Directive. To exercise it, contact info@gukkimukk.com.

This clause does not affect your statutory rights in respect of defective, damaged, or non-conforming goods.

Loyalty points and subscriptions

We may offer loyalty points, ranks, or subscription tiers. These features have no cash value, cannot be transferred or sold, and may be modified, suspended, or discontinued at our discretion. Subscription billing, renewal, and cancellation terms are presented at the point of subscription and managed through Stripe's customer portal.

Wallet linking

You may optionally link a Solana wallet to your Gukkimukk account for community access or token-gated drops. Wallet linking is sign-only — no transaction is broadcast, no gas is spent, and we never have custody of your assets or private keys. We make no representations about the value or availability of any token or NFT.

Intellectual property

All trademarks, logos, designs, photographs, copy, illustrations, and other content displayed on the Services are owned by Gukkimukk or used under licence. You may not copy, reproduce, modify, distribute, sell, or create derivative works from the content without our prior written permission, except as expressly permitted by applicable law.

We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services for personal, non-commercial purposes.

User submissions

If you submit content to us (for example applications, support messages, or community posts) you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, and display that content for the purpose of operating and promoting the Services. You confirm that you have the right to submit the content and that it does not infringe any third-party rights or applicable law.

Acceptable use

You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose;
• Attempt to gain unauthorised access to any part of the Services;
• Interfere with or disrupt the integrity, performance, or security of the Services;
• Submit false or misleading information at checkout, signup, or in any communication;
• Reverse-engineer, scrape, or harvest data from the Services without our written consent;
• Use the Services in a way that violates applicable export-control, sanctions, or trade laws.

Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or free of harmful components.

Nothing in this section limits any mandatory statutory warranties or consumer rights that cannot be excluded under applicable law.

Limitation of liability

To the maximum extent permitted by law, Gukkimukk and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Services. Our aggregate liability for any claim arising from or related to the Services will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim and (b) one hundred euros (€100).

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Indemnification

You agree to indemnify and hold harmless Gukkimukk from any third-party claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right. This clause does not apply to consumers acting outside their trade, business, or profession to the extent that applicable law prohibits it.

Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services if you breach these Terms, if continued provision would expose us to legal risk, or if we discontinue the Services. On termination, the clauses that by their nature should survive (including those on intellectual property, liability, indemnification, and governing law) continue to apply.

Changes to these Terms

We may update these Terms from time to time. When changes are material we will notify account holders by email and/or by prominent notice on the site. Continued use of the Services after the effective date of the updated Terms constitutes acceptance.

Governing law and jurisdiction

These Terms are governed by the laws of [GOVERNING_LAW_JURISDICTION], without regard to its conflict-of-laws principles. Any dispute arising from or in connection with these Terms or the Services will be subject to the exclusive jurisdiction of the courts of [JURISDICTION_COURTS], subject to any mandatory consumer-protection rules that grant you the right to bring proceedings in the courts of your country of residence.

Miscellaneous

These Terms, together with the Privacy Policy, Cookie Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and us regarding the Services.
